Acceptance of Terms
By accessing or using this service, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.
Description of Service
ImageWise provides browser-based image utilities and AI-assisted image translation, description, analysis, generation, enhancement, object removal, text removal, watermark removal, and related features. Feature availability, supported formats, output quality, and usage limits may vary by tool and plan. We may modify, suspend, or discontinue a feature with reasonable notice where possible.
User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use or security breach.
Acceptable Use
You agree not to:
- Violate any applicable laws or regulations.
- Infringe on the intellectual property or other rights of any party.
- Attempt to gain unauthorized access to our systems or data.
- Interfere with or disrupt the integrity or performance of the service.
- Use the service to send spam, malware, or other harmful content.
- Upload content that you do not have the right or permission to process.
- Use the service to create unlawful, deceptive, abusive, or privacy-invasive content.
- Remove or alter a watermark, copyright notice, author signature, attribution, provenance indicator, licensing notice, or other rights-management information unless you own the content or have express authority to do so.
- Alter identification documents, certificates, receipts, invoices, evidence, safety information, ownership records, or other materials in a way that facilitates fraud, misrepresentation, or evasion of verification.
- Misrepresent an edited or generated image as authentic, unaltered, officially issued, or endorsed by another person or organization.
Your Content
You retain your rights in images, instructions, and other material you submit. You grant us and our service providers a worldwide, non-exclusive, limited license to host, copy, transmit, modify, and process that content only as reasonably necessary to provide, secure, troubleshoot, and enforce the service.
You represent and warrant that you own your submitted content or have all permissions, licenses, consents, and lawful authority required to upload and process it. You are solely responsible for your masks, instructions, source images, downloads, publication, distribution, and use of resulting output. ImageWise does not verify or grant ownership rights in uploaded material.
When you select “I own this image or have permission to edit it” or submit a similar confirmation, you make an affirmative representation and warranty that the statement is accurate for the specific image and requested edit. The confirmation does not transfer rights to you, create a license, or mean that ImageWise has verified ownership. You should retain evidence of the applicable ownership, license, consent, or permission.
Text, Object, and Watermark Removal
Text removal, object removal, watermark removal, inpainting, metadata removal, and similar editing tools are provided only for lawful editing of content you own or are authorized to modify. Appropriate uses may include removing your own outdated logo, a date stamp you added, an internal proof or review mark, or an overlay from client material when the rights holder has approved the edit. A tool's technical ability to remove visible material does not give you permission to remove it.
You must not use these tools to remove a stock-image agency watermark, photographer or artist signature, copyright notice, attribution, ownership mark, licensing notice, provenance or authenticity indicator, or other third-party rights-management information without express authority. You must also not use them to conceal infringement, falsify provenance, impersonate another party, defeat ownership or authenticity checks, or create misleading records.
We may require a rights confirmation before processing, record that confirmation with task metadata, apply automated or manual safeguards, refuse a request, remove stored task files, restrict a feature, or suspend or terminate an account when we reasonably believe a use is unlawful, unauthorized, deceptive, repeatedly abusive, or likely to harm another party. A confirmation does not limit our right to investigate a report or request evidence of authorization.
AI Results
AI-generated translations, descriptions, analyses, and prompts may contain errors or omissions. Results can also vary between requests. You are responsible for reviewing output before using it in publishing, commerce, legal, medical, safety-critical, or other consequential contexts.
AI Content Generation Limits
ImageWise applies the AI Use Policy to all AI-assisted generation and transformation features, including image enhancement, upscaling, inpainting, and prompt generation. You must not use these features to create or transform prohibited content. We may remove content, restrict features, suspend or terminate accounts, and take other action described in that policy when we identify or receive a report of a violation.
AI Model Disclosure
ImageWise currently uses the following named models for its AI-assisted image features:
- GPT-4o mini for default visual understanding tasks such as image description, analysis, prompt generation, and visual Q&A.
- PaddleOCR-VL-1.6 for image text recognition and layout-aware translation workflows.
- fal-ai/topaz/upscale/image for AI image enhancement and 2x–4x upscaling.
- fal-ai/flux-pro/v1/erase for supported inpainting and object-removal workflows.
- FLUX 2 Flash, Nano Banana 2, Nano Banana Pro, Seedream 4.5, Seedream 5.0 Lite, Seedream 5.0 Pro, GPT Image 1.5, and GPT Image 2 for image generation, reference-image editing, and other supported image-creation workflows.
Some installations may use Gemini 2.5 Flash as a configured alternative for visual understanding. Available models can vary by feature, provider configuration, and regional availability. We will update this disclosure before materially changing the models used for these features.
Third-Party Services
Some features depend on third-party AI, infrastructure, storage, analytics, email, and payment providers. Your content may be transmitted to those providers to complete your request. Provider availability, safety rules, processing times, and output can change. We are not responsible for third-party services beyond the extent required by applicable law.
Payment and Billing
Paid features are billed in advance for the selected billing period. Usage allowances, renewal terms, and included features are shown at checkout. You are responsible for accurate billing information. Except where required by law, completed usage and consumed AI processing are generally non-refundable. Contact support if you believe a billing error occurred.
Intellectual Property
The service and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.
Copyright and Rights Complaints
If you believe content processed or stored through ImageWise infringes your rights, email [email protected] with: identification of the protected work; identification of the relevant content, URL, or task; your contact details; a good-faith statement that the use is unauthorized; a statement that the information is accurate and that you are the rights holder or authorized to act for them; and your physical or electronic signature.
We may remove or disable access to reported content, preserve relevant records, notify the affected user, request additional information, and terminate repeat infringers where appropriate. Knowingly submitting a false complaint may create liability under applicable law.
Termination
We may suspend or terminate your access, refuse processing, remove stored content, or preserve relevant records if you violate these Terms, create legal or security risk, misuse third-party services, or expose ImageWise or another party to potential liability. We are not required to monitor every upload or determine ownership before processing. You may close your account at any time through your account settings.
Disclaimer of Warranties
The service and all output are provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not warrant that output will be accurate, lawful for your intended use, free of third-party rights, authentic, complete, or suitable as evidence. You must independently review the source material, permissions, and output before use.
Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless ImageWise and its operators, affiliates, personnel, and service providers from claims, losses, liabilities, damages, and reasonable costs arising from your content, your instructions or edits, your use or distribution of output, your violation of these Terms, or your infringement of another party's rights.
Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of your use of or inability to use the service. Our aggregate liability for claims relating to the service will not exceed the greater of the amount you paid ImageWise during the 12 months before the event giving rise to the claim or US$100. These limitations do not exclude liability that cannot lawfully be limited or excluded.
Changes to These Terms
We may modify these Terms at any time. We will notify users of any material changes by updating the date at the top of this page and, where appropriate, sending a notice through the service.
